The Microsoft SQL Server 6.5 Service Pack 5 ("Service Pack") contains updated versions of the software listed herein.  

NOTICE:  THE LICENSE TERMS FOR THIS SERVICE PACK VARY DEPENDING UPON WHICH OF THE APPLICABLE MICROSOFT SOFTWARE PRODUCTS YOU PREVIOUSLY LICENSED.  IF YOU HAVE LICENSED A MICROSOFT SQL SERVER OR SQL WORKSTATION PRODUCT OR A MICROSOFT PRODUCT THAT CONTAINS MICROSOFT SQL SERVER OR SQL WORKSTATION, THE TERMS OF SECTION I APPLY TO YOU.  IF YOU HAVE LICENSED A MICROSOFT PRODUCT THAT CONTAINS MICROSOFT SQL SERVER TECHNOLOGY, THE TERMS OF SECTION II APPLY TO YOU.

SECTION I:

IF YOU ARE LICENSING THIS SERVICE PACK AS PART OF MICROSOFT SQL SERVER OR MICROSOFT SQL WORKSTATION, THE FOLLOWING TERMS APPLY TO YOU:

NOTE: IF YOU DO NOT HAVE A VALID LICENSE FOR MICROSOFT SQL SERVER 6.5,  MICROSOFT SQL SERVER, ENTERPRISE EDITION 6.5, MICROSOFT SQL WORKSTATION 6.5, MICROSOFT BACKOFFICE SERVER 4.0, OR ANY OTHER MICROSOFT PRODUCT WHICH INCLUDES MICROSOFT SQL SERVER 6.5, MICROSOFT SQL SERVER, ENTERPRISE EDITION 6.5 OR MICROSOFT SQL WORKSTATION 6.5, YOU ARE NOT AUTHORIZED TO USE THIS SERVICE PACK.

The Service Pack is licensed under the same terms and conditions contained in the End User License Agreement you acquired with Microsoft SQL Server 6.5, Microsoft SQL Server, Enterprise Edition 6.5, Microsoft SQL Workstation 6.5, or any other Microsoft product which includes any of the foregoing products (for example, Microsoft BackOffice Server 4.0 or Microsoft BackOffice Small Business Server 4.0), as applicable (each a "EULA"), and the terms and conditions set forth in this license.txt file.  Clustering and three (3) gigabyte memory support are features of Microsoft SQL Server, Enterprise Edition 6.5 only, and therefore, you are licensed to install and use the components of this Service Pack applicable to such features only if you have a valid license for Microsoft SQL Server, Enterprise Edition 6.5. 
 IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH HEREIN, YOU ARE NOT AUTHORIZED TO USE THIS SERVICE PACK. 
SECTION II:

IF YOU ARE LICENSING THIS SERVICE PACK AS PART OF THE SQL SERVER FEATURE OF MICROSOFT WINDOWS NT SERVER, ENTERPRISE EDITION 4.0 OR OF MICROSOFT COMMERCIAL INTERNET SYSTEM 2.0, THE FOLLOWING TERMS APPLY TO YOU:

NOTE: IF YOU DO NOT HAVE A VALID LICENSE FOR MICROSOFT WINDOWS NT SERVER, ENTERPRISE EDITION 4.0 OR MICROSOFT COMMERCIAL INTERNET SYSTEM 2.0 YOU ARE NOT AUTHORIZED TO USE THIS SERVICE PACK.  

The Service Pack is licensed under the same terms and conditions contained applicable to the SQL Server Feature that are contained in the End User License Agreement you acquired with Microsoft Windows NT Server, Enterprise Edition 4.0 or Microsoft Commercial Internet System 2.0, as applicable (each a "EULA"), and the terms and conditions set forth in this license.txt file.  Because clustering and three (3) gigabyte memory support are features of Microsoft SQL Server, Enterprise Edition 6.5 only, you have no right to install or use any components of the Service Pack which are applicable to such features. 
 IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH HEREIN, YOU ARE NOT AUTHORIZED TO USE THIS SERVICE PACK.
